These Terms of Service (“Terms”) govern your access to and use of fitaqua.shop and any purchase from FITNESS & AQUATIC CENTER LLC(“Fitaqua”). By using the site or placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to purchase from us.

Products & descriptions

We try to describe and show products accurately, but colors and details may vary slightly. Product descriptions are for general information and do not constitute medical, safety or professional advice.

Intended use & important disclaimers

Fitaqua products are fitness and training accessories. By purchasing, you acknowledge and agree that:

• Buoyancy items (including the training buoyancy belt and kickboards) are training aids only. They are not personal flotation devices (PFDs), life jackets, or lifesaving devices, are not Coast Guard approved, and must never be relied upon to prevent drowning or to keep any person safe in the water.
• Our products are not medical devices and are not intended to diagnose, treat, cure, rehabilitate or prevent any disease, injury or condition.
• You will train only in water and conditions appropriate to your ability, never alone, and with qualified supervision present. Children must be supervised at all times.
• Use of all products is at your own risk. Consult a physician before starting any exercise program.

Pricing & payment

• All prices are in US Dollars (USD) and exclude any import duties or taxes that may apply to international orders.
• We accept major cards via Stripe and PayPal. Card charges appear as FITAQUA.
• We may correct pricing errors and decline or cancel orders, including where stock is unavailable or fraud is suspected.

Orders & contract formation

Your order is an offer to buy. A binding contract forms when we send an order confirmation or dispatch the goods. See our Refund & Returns Policy and Shipping information.

Intellectual property

All content on this site — including the Fitaqua name, logo, text and images — is owned by us or our licensors and may not be used without permission.

Limitation of liability

To the maximum extent permitted by law, Fitaqua is not liable for any indirect, incidental or consequential damages arising from your use of the site or products, or from any misuse of products contrary to these Terms and the safe-use guidance provided. Nothing limits liability that cannot be excluded by law.

Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes are subject to the courts located in Florida, USA.
